In addition to the great factors you mentioned, mediation works when both parties are invested in the mediation. If one party is unreasonable or wants to make the other party pay, then mediation will not work.

Ned,

I hope that by now you have received an answer to your question.

I don't have legal knowledge or experience in this case, but I am sympathetic to your situation, as I am in similar one.

My wife and kids are in WA, and I am in CA contemplating the pros and cons of legal separation while hoping for a reconciliation.

I pray that you are getting wise counsel, have the positive support of family and friends, and that your child (or children) will always know and feel your love as a father.

I filed for a legal separation in CA (just moved here). The spouse filed for a dissolution in WA (where I moved from) but did not file a response to the legal separation. She claims the court has no personal jurisdiction over monetary judgments without in state service (child support and spousal support seem to be monetary judgments). If I move forward with the separation and get the temporary orders can they be enforced on her in another state or can she do what she calls a collateral attach against the monetary judgments. In other words is it worth it to proceed down here or do I have to proceed in Washington? (she works in an attorney’s office and acts like she knows what she is talking about).
