If you and your spouse agree on all issues, including property and debt division, child and spousal support, and parenting issues including custody and visitation schedules, then you can avoid litigation and appearing in court. This is known as an uncontested divorce, and it costs substantially less than a litigated divorce case.

When an Uncontested Divorce Is or Is Not Appropriate

In an uncontested divorce case, parties can represent themselves, or one or both of them can retain an attorney. However, an uncontested divorce is not appropriate for every case. If you have a large estate, complex legal matters, or domestic violence issues, an uncontested divorce is most likely not for you.

The Mediation Alternative

Divorcing spouses can proceed through Divorce Mediation, which is also an uncontested process because neither party appears in court, and the cost is considerably lower than a litigated divorce case. In mediation, you and your spouse meet together in a low-conflict setting with a mediator who acts as a neutral third party and assists you in reaching mutual decisions concerning your divorce, no matter the size of the estate or the complexity of the legal issues.
